5. Disclosures in the Preceding 12 Months

Based on Apex’s stated practices as of the Effective Date, during the preceding 12 months Apex may have disclosed for a business purpose the categories listed in the table above to the corresponding categories of recipients. Apex does not sell Personal Information in exchange for money.

Apex currently uses Google Analytics. Depending on the technology’s configuration, applicable contractual terms, and California law, disclosure of Identifiers and Internet or electronic network activity to an analytics provider may be considered a “sale” or “sharing” even when no money is exchanged.

Apex has advised that Meta Pixel, other advertising pixels, expanded lead-sharing, email marketing, and related marketing tools are planned but were not yet active as of the Effective Date. Once enabled, those practices may involve selling or sharing, as defined by the CCPA, Identifiers, Commercial Information, Internet or electronic network activity, approximate Geolocation Data, and Inferences with advertising, analytics, social-media, or referral partners. Apex must update this section and activate the required opt-out mechanisms before or when those practices begin.

6. Sale, Sharing, and Targeted Advertising Choices

Apex does not sell Personal Information for monetary payment. However, certain disclosures through analytics, advertising, or referral technologies may constitute “sale” or “sharing” under the CCPA.

California residents may request to opt out of the sale or sharing of their Personal Information by:

– using the Do Not Sell or Share My Personal Information or Manage Cookies link made available on the Apex website;
– disabling advertising or targeting technologies through the website’s cookie-preference tool; or
– contacting Apex using the methods in Section 10.

Where required, Apex will treat a legally recognized browser-based opt-out preference signal, such as Global Privacy Control, as a request to opt out for the browser or device transmitting the signal. Cookie choices and browser signals may be device- and browser-specific.

Apex does not knowingly sell or share the Personal Information of consumers under 16 years of age.

7. Sensitive Personal Information

Apex may use or disclose Sensitive Personal Information when reasonably necessary to provide insurance or services requested by a consumer, verify and maintain service quality, process or secure transactions, resist fraud or unlawful activity, ensure physical or information security, comply with law, or carry out another purpose permitted by the CCPA.

Apex does not use or disclose Sensitive Personal Information for the purpose of inferring characteristics about a consumer beyond uses permitted without offering a right to limit. If Apex begins using Sensitive Personal Information for a purpose that creates a right to limit under the CCPA, Apex will provide the required notice and method to exercise that right before the new use begins.

8. California Privacy Rights

Subject to applicable exceptions and verification requirements, California residents may have the right to:

– Know and access: Request the categories or specific pieces of Personal Information Apex has collected, the sources, purposes, categories of recipients, and information concerning sales, sharing, or disclosures for a business purpose.
– Delete: Request deletion of Personal Information Apex collected, subject to legal and operational exceptions.
– Correct: Request correction of inaccurate Personal Information maintained by Apex.
– Opt out: Direct Apex not to sell or share Personal Information.
– Limit certain uses of Sensitive Personal Information: Direct Apex to limit use and disclosure when the information is used beyond purposes permitted without a right to limit.
– Data portability: Receive eligible Personal Information in a portable and, where technically feasible, readily usable format.
– Non-discrimination: Receive equal service and pricing and not be retaliated against for exercising CCPA rights.

These rights may not apply to information exempt from the CCPA, including certain information governed by GLBA, the California Financial Information Privacy Act, the Fair Credit Reporting Act, the Driver’s Privacy Protection Act, HIPAA, the California Confidentiality of Medical Information Act, or other insurance, financial-services, health, or sector-specific laws.

9. Requests Through Authorized Agents

An authorized agent may submit a request on your behalf as permitted by California law. Apex may require the agent to provide proof of authorization and may contact you directly to verify your identity and confirm that you authorized the request. Apex may deny a request from an agent that does not provide adequate proof of authority.

Apex will use Personal Information provided with a request only to verify the requestor’s identity or authority and to process the request. Apex may request additional information when reasonably necessary for verification. If identity or authority cannot be verified, Apex may be unable to fulfill the request.

11. Financial Incentives

Apex does not currently offer financial incentives, price differences, or service differences in exchange for the collection, sale, sharing, or retention of Personal Information. If Apex introduces such a program, it will provide the notice and obtain any opt-in consent required by California law.

Apex considers the duration of the client or prospect relationship, the sensitivity and volume of information, insurance and licensing recordkeeping requirements, legal and contractual obligations, limitation periods, fraud and security needs, and the need to establish or defend claims. At the end of the applicable retention period, Apex will delete, de-identify, or securely dispose of the information, subject to law.

Apex may update this California Notice to reflect changes in its practices, technology, services, or legal obligations. The updated version will be posted with a revised effective date. Apex will provide additional notice or obtain consent when required by law.
